لانسنغ – أعلن قاضي فدرالي الخميس الماضي عدم دستورية جزء من قانون الاحتجاج في المواكب الجنائزية العسكرية، كانت ميشيغن سنته على عجل، يتعلق بحظر سلوكيات احتجاجية (ضد الحرب) بداعي التأثير السلبي على تلك المواكب أو مراسم التأبين
وجاء قرار القاضي نظرا لما يعتري هذا البند من تجاوزات لحق التعبير عن الرأي إضافة الى ضبابية تجعل من الصعب على الشرطة تنفيذ مهامها بدقة. وكان القاضي الفدرالي طوماس ليدنغتون امر بالابقاء على بنود في هذا القانون، تنص على حظر الصراخ لمسافة تصل الى 500 قدم، لأن ذلك، حسب القاضي، قد يؤدي الى اثارة الخوف أو البلبلة في قلوب الحاضرين لمثل هذه المواكب والمراسم.
وجاء هذا الحكم بمثابة نصر لأحد جنود الجيش الاميركي القدامى ويدعى لويس لاودين (66 عاما)، وهو من مقاطعة غراتيوت، والذي كان قد أُبعد عن وزوجته الراحلة جيين عن موكب جنائزي في مقاطعة كلير عام 2007 اقيم لاحد الجنود القتلى في حرب العراق. حينها قام ضابط من مكتب الشريف باستبعادهما بسبب وضعهما لافتة على زجاج سيارتهما ينددان فيها بالحكومة الاميركية، حيث ألقي القبض عليهما وأمضيا ليلة في السجن، واسقطت عنهما تهماً بإخفاء أسلحة وسكاكين داخل سيارتهما (كانت تستخدم في التخييم). تبع ذلك رفع الزوجين دعوى ضد مكتب الشريف بتهمة اختراق الضابط لحقوقهما الدستورية.
الى ذلك اشاد محامي الزوجين هيو دانيس المنتدب من اتحاد الحريات المدنية الاميركية بقرار القاضي، كما اشاد به مكتب المدعي العام في ميشيغن. وبحسب القرار فقد اسقطت التهم الموجهة لمكتب الشريف، على ان تستمر محاكمة الضابط. في المقابل قال محامي المقاطعة جايسن كولكيما ان على المقاطعة التقرير ما إذا تود استئناف الحكم، حيث ان قانون الاحتجاج في الجنائز سن في ميشيغن عام 2006، عقب قيام الكنيسة المعمدانية في ديستبورو (كنساس) برفع يافطات في مواكب الجنود القتلى تقول “نحمد الله على سقوط الجنود” فهذا عقاب من الله للاميركيين لسماحهم بالعلاقات المثلية.
