سان فرانسيسكو - أصدر قاض فدرالي حكماً فـي دعوى قضائية رفعتها منظمة «بيتا» المدافعة عن حقوق الحيوان بعدم أحقية قرد نادر ذي عرف من فصيلة «المكاك» فـي الحصول على حقوق نشر صورة «سيلفـي» التقطها لنفسه لأنه ليس انساناً.
ورفعت منظمة «ناس من أجل معاملة أخلاقية للحيوانات» (بيتا) الدعوى فـي أيلول (سبتمبر) نيابة عن القرد ناروتو البالغ من العمر سبع سنوات ضد المصور البريطاني ديفـيد سلاتر الذي نشر الصورة فـي كتاب عن الحياة البرية.
وأفادت الدعوى أن القرد ناروتو الذي يقيم فـي محمية طبيعية فـي أندونيسيا التقط الصورة وعدة صور أخرى فـي عام 2011 باستخدام كاميرا تركها سلاتر.
وتقول بيتا إنه صاحب الحق فـي هذه الصور ويتعين أن يحصل على تعويضات عن انتهاك حقوق الملكية الفكرية تستخدم فـي تحسين البيئة التي يعيش فـيها.
ولكن القاضي وليام أوريك قال فـي محكمة سان فرانسيسكو الفدرالية وفقا لوثائق المحكمة إن الكونغرس الأميركي والرئيس لديهما سلطة مد الحماية القانونية للحيوان والإنسان على حد سواء «لكن ليس هناك ما يشير إلى انهما قاما بذلك فـي قانون حقوق الملكية الفكرية».
وقال جيف كير المحامي العام فـي «بيتا» لوكالة «رويترز» إن الجماعة تدرس خياراتها القانونية. وأضاف «نشعر بخيبة أمل لكننا نحتفل بحقيقة أن هذه قضية تاريخية»، وتابع «نجادل لأول مرة بأن حيواناً يمكن أن يكون مالكاً لشيء بدلاً من أن يكون هو نفسه مجرد شيء مملوك».
