واشنطن – صدر تقرير عن منظمة ”هيومن رايتس ووتش” الثلاثاء الماضي يطالب الكونغرس الأميركي بتغيير قانون فدرالي، اعتبرته المنظمة أنه يمنع السجناء من الحصول على حقوق متساوية مع غيرهم، ويمنعهم من الحصول على العدالة بشكل متساو، خصوصا بعد انتهاكات سجن أبو غريب في العراق. وذكر التقرير الذي كان بعنوان، ”عدالة غير متساوية” الذي عالج موضوع قانون السجون والسجناء في الولايات المتحدة الذي أصدره الكونغرس عام ١٩٩٦، والذي اعتبرته المنظمة أنه يميز بين السجناء، ويضع حقوقا غير متساوية لهم، من حيث المحاكمة أو المعاملة بالسجن.
وذكر ديفيد فتحي مدير برنامج الولايات المتحدة في المنظمة أن ”العالم قد صدم بعد الاعتداءات التي جرت على سجناء أبو غريب”، مضيفا أنه ”حتى إذا ما تمت هذه الجرائم في سجن أميركي فإنه بحسب القانون لن يتم معالجتها”.
والقانون، بحسب التقرير، يحد من حقوق ٣,٢ مليون سجين من البالغين والأطفال في الوصول إلى المحاكم الفدرالية، ورأى التقرير أن هناك ٥ أشياء في هذا القانون تثير القلق من ناحية تطابقها مع حقوق الإنسان.
أما أول هنات هذا القانون، تتعلق بأنه يمنع السجين الذي يتقدم بشكوى داخلية من إيصال شكواه إلى المحكمة.
وبالنسبة للإشكالية الثانية في القانون، رأى التقرير أنه يتعلق بالفقرة في القانون التي تنص على أن السجناء الذين يتم الاعتداء عليهم لا يحق لهم التقدم بشكوى إلا إذا أصيبوا بجروح مادية، وهو أمر يتيح المجال أمام شتى أنواع الجروح النفسية والإساءات اللفظية سواء من قبل السجانين أو السجناء.
ورأى التقرير أن الإشكالية الرابعة في القانون هي متجسدة بأن الفقرات المذكورة أعلاه، تطبق كذلك على الأطفال والأحداث، وهو ما رآه التقرير يتعارض مع حقوقهم.
وحول الإشكالية الخامسة، ورد في التقرير أنه يتلخص بأن القانون ينص على أنه إذا ما رفع أحد السجناء دعوى وربحها، فإن الأتعاب التي يجب أن يسددها لمحاميه هي محدودة ولا تتجاوز سقفا معينا. وختاما رأى التقرير أن القانون يحرم بعض السجناء بمعاملة متساوية مع غيره، ويحد من أي إصلاحات أو علاجات لأوضاع هذا النوع من السجناء.
